Terms of Service

Welcome to Curated ("Curated," "we," "us"). These Terms of Service ("Terms") govern your use of the Curated mobile app, curated.network, and related services (the "Service"). By using the Service you agree to these Terms.
1. Account Eligibility
You must be at least 13 years old to use Curated. If you are between 13 and the age of majority in your jurisdiction, you must have permission from a parent or guardian. You are responsible for the activity on your account and for keeping your credentials secure.
2. User Content and License
You retain all intellectual property rights in the lists, items, descriptions, images, and other content you submit ("Curator Content"). By submitting Curator Content, you grant Curated a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, distribute, and create derivative works (such as AI-assisted enrichment via Anthropic Claude) of that content solely to operate, promote, and improve the Service. This license ends when you delete the content or your account, except for backups and content already licensed to paying purchasers.
3. Prohibited Content and Conduct
You agree not to publish or transmit content that is: (a) NSFW or sexually explicit without an age gate; (b) illegal, infringing, or fraudulent; (c) spam or low-effort bulk listings; (d) professional financial, medical, or legal advice presented as such; (e) scraped from third parties without permission; or (f) hateful, harassing, or threatening. 4. Purchases (Stripe)
Paid lists are sold on the web through Stripe — one-time purchases via Stripe Checkout, recurring subscriptions via Stripe Billing. Stripe processes all payments; Curated does not receive or store payment card details. Refunds and cancellation terms are presented at checkout and are governed by the cancellation policy disclosed at that time. The iOS app is a reader: it surfaces lists tied to your account's existing entitlements and does not process payments.
5. Curator Revenue and Payouts
After Stripe processing fees, Curated retains 15% of net revenue as a platform fee and remits 85% to the curator. Payouts are made via Stripe Connect Express on a monthly schedule, subject to a hold (typically 30 days, 60 days for new curators) to cover refunds, chargebacks, and disputes. Curators must maintain a valid Stripe Connect account. Additional terms appear in the Curator Agreement.
6. Suspension and Termination
We may suspend, restrict, or terminate accounts that violate these Terms, our Content Policy, applicable law, or that create undue risk to the Service or other users. You may close your account at any time from app settings.
7. Disclaimers
The Service is provided "as is" without warranties of any kind. Curator recommendations are opinions, not professional advice. To the maximum extent permitted by law, Curated disclaims all implied warranties and is not liable for indirect, incidental, or consequential damages. Our aggregate liability is limited to amounts you paid Curated in the prior 12 months.
8. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Any dispute will be resolved by binding individual arbitration administered by JAMS in Delaware. You and Curated waive the right to a jury trial and to participate in class actions, except where prohibited by law.
