DMCA Notice and Takedown Policy

Curated respects the intellectual property rights of others and expects users of the Service to do the same. This policy explains how to report content on Curated that you believe infringes your copyright, and how counter-notifications and repeat-infringer actions work, in line with the U.S. Digital Millennium Copyright Act (DMCA), 17 U.S.C. Section 512.

Designated Copyright Agent

Notices of claimed infringement should be sent to our designated agent (registered with the U.S. Copyright Office):

Submitting a DMCA Notice

To be effective, your written notice must include all six elements required by 17 U.S.C. Section 512(c)(3):

  1. A physical or electronic signature of the owner, or of a person authorized to act on behalf of the owner, of the exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works on the Service are covered by a single notice.
  3. Identification of the material that is claimed to be infringing or the subject of infringing activity, with enough detail (such as the list URL and item title) for us to locate it.
  4. Contact information for you, including address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner of the right that is allegedly infringed.

Our Response

We aim to review valid notices within 2 business days. If the notice appears valid, we will remove or disable access to the material and notify the user who posted it. Knowingly submitting a materially false notice may subject you to liability for damages under Section 512(f).

Counter-Notification

If you believe your content was removed in error, you may send a counter-notification to dmca@curated.network including:

  1. Your physical or electronic signature.
  2. Identification of the material and its prior location.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
  4. Your name, address, and phone number, and consent to the jurisdiction of the federal district court for your district (or, if outside the U.S., the District of Delaware), and that you will accept service from the original complainant.

If we receive a valid counter-notification and the complainant does not file a court action seeking a restraining order within 10 to 14 business days, we may restore the content.

Repeat Infringer Policy

Curated maintains a three-strikes policy: accounts that receive three valid, unresolved DMCA notices will be terminated, and payouts may be paused pending review. We may terminate sooner in cases of egregious or willful infringement.
